FREE PASSAGE REGULATIONS
regulation for the selection
of persons in Britain for free passage to this Colony |
|
His Excellency the Governor-in-Chief having, with the advice of
the Executive Council, frames the following Regulation for the issuing
of Embarkation Orders, and the granting of remission certificates
in accordance with the powers to that effect conferred by the Act
no. 4, 21st Victoria “To authorize the appointment of an Emigration
Agent and to encourage and regulate Immigration into the Province
of South Australia,” the same are now published for general information. |

Free Passage Regulations |
Regulation for the selection of persons in Britain
for free passage to this Colony. |
|
1. |
Eligible Candidates:—
The candidates must be in the habit
of working for wages at one of the callings mentioned in article
3, and must
be going out with the intention of working for hire in that calling.
They must be sober, industrious, of good moral character, in good
health, free from all mental and bodily defects, within the ages
specified, appear physically to be capable of labour, and have been
vaccinated or had small-pox.
Ineligible candidates:—
Passage cannot
be granted to persons in business, or intending to set up in business
in the Colony for themselves ; to buy land, or to resort to the goldfields
; to persons in the habitual receipt of parish relief ; to widowers
and widows with young children ; to parents without all their children
under 16 in Britain ; to children under sixteen without their parents
; to husband without their wives, or wives without their husbands
; to single men over forty ; to single women over thirty five ;
to single women who have had illegitimate children ; or to persons
who
have not arranged with their creditors. |

Application and Approval |
|
|
2. |
The first step is to address her Majesty’s Land and Immigration
Commissioners in London, or their nearest selecting agent, for an
application form, which must be accurately filled up and returned
to the officer issuing same. If the applicants are married, the certificate
of their marriage must be sent at the same time. Time and place for
a personal inspection of the applicants will thereafter be appointed,
and they will also be informed what other certificates (if any) are
required in support of their application. The candidates will, on
or after inspection, be informed whether or not a passage be granted.
If it can, they will, as soon as possible, receive an embarkation order from
Her Majesty’s Land and Immigration Commissioners (which ever is transferable)
naming the ship in which they are to sail, and the time and place of joining
her. |

Classes eligible |
|
|
3. |
The following are the classes eligible for selection for free
passage:
1. Married agricultural
laborers, shepherds, herdsman, and copper
miners, not exceeding forty-five years of age.
2. Single men, or
widowers without children under sixteen, of any of the above classes,
not exceeding forty-five year of age.
3. Single female domestic
servants or widows without children under the sixteen, not exceeding
thirty-five
years of age.
4. Married mechanics (when
required in the colony), such as masons, bricklayers and farriers,
wheelwrights, sawyers,
carpenters, &c. also gardeners, not exceeding forty-five years
of age.
5. Single men of class 4 (when required) not exceeding forty-five
years of age.
The emigrants under these regulation-personally in
the case of single adults, and by the head of the family in other
cases-must prior to embarkation, id required to do so, sign an
undertaking
(Schedule D) not to quit South Australia for at least the space
of two years after arrival. |

Outfit Etc. |
|
|
4. |
Candidates must find their own outfit, which will inspected before
embarkation by an officer of the Land and Immigration Commissioners.
The smallest Quantity that will be allowed is for each male over
twelve, six shirts, six pairs of stockings, two warm flannel shirts,
two pair of new shoes or boots, two complete suits strong exterior
clothing, four towels, and 2lb marine soap ; and for each female
over twelve, six shifts, two flannel petticoats, six pair of stockings,
two pair of strong boots or shoes, two strong gowns (one of which
must be made of warm material), four towels, and 2lbs of marine soap.
N.B. If any difficulty is experienced in procuring good marine soap
where the applicant reside, there will be ample opportunity for purchasing
it after their arrival in the depot.
Two or three colored shirts
for men, and an extra supply of flannel for women and children
are very desirable. The quantity of baggage for each person over
twelve
must not exceed twenty cubic or solid feet, nor half a ton in
weight. It must be closely packed in one or more strong boxes or
cases not
exceeding fifteen cubic feet each. Larger packages and extra
baggage, if taken at all, must be paid for. Mattresses and feather
beds, firearms,
and offensive weapons, wines, spirits, beer, gunpowder, percussion
caps, Lucifer matches, and any dangerous or noxious articles,
cannot be taken by emigrants. |

Caution |
|
|
5. |
Candidates must not reckon upon passages, or make any preparations
for departures, unless they receive notice that they have been
approved on inspection. Persons cannot be received on board ship
without an
embarkation order issued by the Land and Immigration Commissioners,
nor unless they are in a fit state of health for the voyage. Any
false signatures, misstatements, or omissions to state a material
fact in the candidates’ papers, or any attempt at deception whatever,
or evasion of these regulation, will debar such candidates from all
after consideration for a passage to this Colony ; and, in the case
of false signature, will, moreover, render the offender liable to
a heavy penalty under the passenger’s act. Failure to attend at
the time, and place of embarkation, without having previously given
to
the Land and emigration Commissioners timely notice, and a satisfactory
reason, or any insubordination or misconduct in the Commissioners
depot, or on board ship before sailing, will subject the candidates
to the loss of their passage.
All communication by intending emigrants
to this colony are, until further notice, to be addressed, post
paid, to S. Walcott Esq. Secretary to the Land and Emigration
Commissioners, no. 8, Park Street, Westminster, London. |

Emigrants Undertaking |
|

have applied to the Land and Emigration Commissioners for passage
to South
Australia
under the “free passage regulation” and whereas I have been approved
of (together with my ........................ and ........................
children under the age of sixteen years) for ........................
passage to that Colony in a Government emigrant vessel, subject to
my giving
the
following
undertaking ;
now therefore, I the Said ........................ do hereby promise
and agree that, if on any pretence whatever, either I or my said
wife or either
of my said children shall quit or attempt to quit South Australia
within the space of two years from and after the date off ........................
arrival at Port Adelaide, I will forfeit and pay to the Commissioners
of
Crown Lands Immigration at Adelaide (or any persons duly appointed
by him) on demand, the sum of Ten Pounds for myself or either and
every of my said family so acting ; and such penalty shall summarily
recoverable from me in any court of competent jurisdiction in the
said Colony.

Assisted Passage Regulations |
|
Regulations under which Settlers may obtain assistance out of the
public funds towards the introduction to this colony from Britain,
of persons in aid of the cost whose passages they may contribute
certain sums. |
|
Conditions |
|
1. |
Any person, resident in this colony, desirous of procuring a passage
from the United Kingdom to South Australia, for Emigrants of the
under mentioned classes, coming within the following regulations,
may effect that by contributing in this office, such sums of money
named hereunder as may apply in each instance (for
application form, see schedule A), subject to the applicant signing
an undertaking (forming part thereof), to provide for the persons
emigrating in virtue of each payment, on the expiry of the vessels
lay days in Port Adelaide, or otherwise to pay to the Government,
for the subsistence of such immigrants at the rate of 1s 6d per day
for each adult, or half that amount for each child under the age
of fourteen years, so long as they may be maintained at the public
expense after the expiration of the of that period mentioned ; such
bond to have force for one year after the date of arrival of their
nominees. |

2. |
On payment of the money at this office, a certificate will be issued
(Schedule B), guaranteeing passages to an equivalent number of person
as per scale hereunder, on presentation of the certificate to the
Land and Immigration Commissioners in London, providing they are
approved on inspection. |
|
|
3. |
The certificate will have 12 months currency ; will be transferable
; and in no case will the contributor have any portion of the money
paid refunded to him. But in order to prevent any injustice arising,
through the non-emigration of any person for whose benefit the
certificate was in the first instance obtained, the Land and Immigration
Commissioners will receive, in Britain, any money balanced which
may be required under the regulation, to entitle the person who
actually claim under the certificate, to passages.

4. |
The emigrants under these regulations personally, in the case
of single adults, of sixteen years upwards, and by the head of
the family, in other cases must, prior to embarkation, if required
to do so, sign an undertaking (Schedule D) not to quit South Australia
for at least the space of two years after arrival.
|
|
|
5. |
Her Majesty’s Land and Immigration Commissioners will, after
approved, issue embarkation orders to persons thus nominated, in
rotation, in according to date of acceptance, so far as may be
consistent with their sanitary precautions the proportion
of young children proper to be embarked with adults in vessels
regard being always had, also, to the current rate of government
emigration to this colony.

in the other Australian Colonies ; to persons in the habitual receipt of
parish relief ; to parents without all their children under sixteen, then
in Britain, to children under sixteen without their parents, to husband
without their wives, or wives without their husbands (unless in the last
three instances, the parents, husband or wives, be in this Colony) ; to
single woman who have had illegitimate children ; or to persons who have
not arranged with their creditors. |
